1. WHO WE ARE

1.1. The Colors of Faith online store (the "Store", "we", "us") is operated by PCMB GROUP Sp. z o.o., a limited liability company registered in Poland, with its registered office at os. Bolesława Chrobrego 37/57, 60-681 Poznań, Poland, company registration number (KRS) 0001223165, Tax ID (NIP) 9721375717.

1.3. These Terms & Conditions (the "Terms") govern your use of the Store and every purchase you make through it. By placing an order, you agree to these Terms. Please read them before ordering.

2. ELIGIBILITY AND ACCOUNTS

2.1. You must be at least 18 years old (or the age of majority in your state) and able to enter into a binding contract to place an order.

2.2. Creating a customer account is optional. An account gives you access to your order history and saved details. You may delete your account at any time by contacting us. You are responsible for keeping your login credentials confidential.

2.3. You agree to use the Store lawfully and not to interfere with its operation, including through bots, scrapers or automated tools.

3. PRODUCTS AND ORDERS

3.1. Product listings in the Store are an invitation to purchase, not a binding offer. Placing an order constitutes your offer to buy the selected products.

3.2. A contract is formed when we send you an order confirmation by e-mail. We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing or listing errors, or stock unavailability. If we cancel your order after payment, we will refund you in full without undue delay.

3.3. Our products are handmade. Minor variations in color, shape and finish are a natural feature of handcrafted goods and do not constitute defects.

3.4. If a product you ordered is unavailable, we will notify you promptly and either offer an extended processing time or refund the affected part of your order in full.

4. PRICES, TAXES AND PAYMENT

4.1. All prices in the Store are expressed in US dollars (USD).

4.2. Prices do not include sales tax. Where required by law, applicable state and local sales tax will be calculated and added at checkout based on your shipping address.

4.3. Available payment methods are shown at checkout. Payment is processed by third-party payment providers; we do not store your full card details.

4.4. A receipt or invoice is issued for every transaction and sent by e-mail.

5. SHIPPING AND DELIVERY

5.1. We ship to addresses in the United States. All US orders are shipped domestically from within the United States, so no customs duties or import charges apply.

5.2. Shipping costs and estimated delivery times are shown at checkout and on our Shipping & Delivery page.

5.3. Risk of loss passes to you upon delivery of the package to the shipping address you provided. Please make sure your address is correct – we are not responsible for packages delivered to an incorrectly provided address.

5.4. If your package arrives damaged or does not arrive, contact us at support@coloursoffaith.com and we will make it right in accordance with our Returns & Refunds Policy.

6. RETURNS AND REFUNDS

6.1. We offer a 30-day return policy for US customers. The full rules, including how to start a return and how refunds are processed, are set out in our Returns & Refunds Policy, which forms part of these Terms.

6.2. Nothing in these Terms limits any rights you may have under applicable law that cannot be waived or limited.

7. WARRANTY DISCLAIMER

7.1. Except as expressly stated in these Terms or in our Returns & Refunds Policy, and to the maximum extent permitted by law, the Store and all products are provided "as is" and we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

7.2. Some states do not allow limitations on implied warranties, so some of the above limitations may not apply to you. This warranty disclaimer does not affect any statutory rights that cannot be disclaimed under applicable law.

8. LIMITATION OF LIABILITY

8.1. To the maximum extent permitted by law, our total liability arising out of or related to any order shall not exceed the amount you paid for that order.

8.2. To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits or data.

8.3. Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. INTELLECTUAL PROPERTY

9.1. All content in the Store, including texts, product designs, photographs, graphics and page layout, is protected by law and owned by us or our licensors. You may not copy, reproduce or use it without our prior written consent.

9.2. If you submit a product review or other content, you grant us a non-exclusive, royalty-free license to use it in connection with the Store and our marketing. You must not submit content that is unlawful, offensive or infringes third-party rights; we may moderate and remove such content.

10. DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER

Please read this section carefully – it affects your legal rights.

10.1. Informal resolution first. If you have any dispute with us, contact us at support@coloursoffaith.com and we will try to resolve it informally within 30 days. Most issues are resolved this way.

10.2. Binding arbitration. If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to these Terms or your purchase shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in English, remotely (by videoconference or on written submissions), unless the AAA rules require otherwise.

10.3. Class action waiver. You and we each waive the right to a trial by jury and the right to participate in a class action, class arbitration or other representative proceeding. Disputes may only be brought on an individual basis.

10.4. Small claims exception. Either party may instead bring an individual claim in small claims court if it qualifies.

10.5. Opt-out. You may opt out of this arbitration agreement within 30 days of your first purchase by e-mailing support@coloursoffaith.com with the subject "Arbitration Opt-Out" and your name and order number. Opting out will not affect any other part of these Terms.

11. GOVERNING LAW

11.1. These Terms and any dispute arising out of them are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs Section 10. If you are a consumer, you retain any rights granted by mandatory consumer protection laws of your state of residence.

12. GENERAL PROVISIONS

12.1. We may update these Terms from time to time. The current version is always available on this page with the "Last updated" date. Changes apply to orders placed after the changes take effect; orders already placed are governed by the version in force at the time of purchase.

12.2. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it.

12.3. These Terms, together with our Shipping & Delivery, Returns & Refunds and Privacy Policy pages, constitute the entire agreement between you and us regarding your purchase.

12.4. The contract is concluded in English.

12.5. Personal data is processed in accordance with our Privacy Policy.
